By accessing or using Petrolytx ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

The iPhone and iPad companion displays saved results created on the web, downloads briefs for offline reference, and synchronizes private notes. It does not recalculate forecasts. A downloaded brief reflects the analysis version and download time shown in the app and may become out of date.

You must be at least 18 years old to create an account. By registering, you represent that you have the authority to bind yourself or your organization to these Terms.
The iPhone and iPad companion is a free download and does not offer in-app purchases. Web subscription terms apply to subscriptions obtained through the web service.
The Free plan does not require a payment method. An eligible account may receive one 14-day trial of a Pro or Business plan. A valid payment method is required to begin a trial, but no subscription charge is due at enrollment ($0 today).
Unless you cancel before the trial ends, your trial automatically converts to the selected monthly or annual subscription. We will charge the price shown at Checkout plus applicable taxes at the end of the trial and at each subsequent billing interval.
Subscription fees are charged in advance. You authorize Stripe to charge the payment method you provide for the selected subscription at the end of the trial and on each billing cycle. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
You may cancel at any time through the Stripe Customer Portal in Settings. To avoid the first paid charge, cancel before your 14-day trial ends. Cancellation takes effect at the end of the current trial or billing period, and you will retain access until then.
Certain subscription plans include "unlimited" access to specific features such as wells, projects, forecasts, or type curves. "Unlimited" means reasonable usage consistent with normal business operations for an individual user or small team. It does not mean infinite or unrestricted usage. We reserve the right to contact users exhibiting abnormally high usage patterns, throttle excessive usage, or establish reasonable limits if usage negatively impacts service performance for other users. Automated, programmatic, or bulk creation of resources beyond what is reasonably necessary for legitimate business purposes may be subject to review.
You retain all rights to the data you upload to Petrolytx. We do not claim ownership of your well data, production information, forecasts, or any other content you provide.
By uploading data, you grant us a limited license to process, store, and display your data solely to provide the Service to you. We will not share your data with third parties except as described in our Privacy Policy.
You are responsible for the accuracy of data you upload. We provide analytical tools but do not guarantee the accuracy of forecasts or analyses, which depend on your input data.
You agree not to use the Service to:
We monitor usage patterns to ensure fair access for all users. If we determine that your usage is excessive, abusive, or inconsistent with the intended purpose of the Service, we may contact you to discuss your usage, temporarily limit your access, or terminate your account in accordance with Section 11.
The Service, including its software, design, logos, and documentation, is owned by Petrolytx and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.
THE SERVICE IS PROVIDED "AS IS"
We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
Petrolytx provides analytical tools for informational purposes only. Results should not be relied upon as the sole basis for business, investment, or operational decisions. You should independently verify all forecasts and analyses before making decisions.
To the maximum extent permitted by law, Petrolytx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Petrolytx, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms.
Upon termination, your right to use the Service will immediately cease. You may export your data before termination. We will retain your data for 30 days after termination to allow for data export, after which it will be deleted.
This export period after service termination does not apply to a deletion request you initiate. Export any data you need before confirming account deletion; unsynchronized local drafts are not included in a server export.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Harris County, Texas.
